GasMap Terms of Service

These Terms of Service govern your use of the GasMap mobile application and related services. GasMap is operated by Olivance Platforms Inc. In these Terms, “GasMap,” “we,” “us,” and “our” refer to Olivance Platforms Inc.

By tapping “I Agree” when these Terms are presented to you, you agree to be bound by them. If you do not agree, do not use GasMap.

Our Privacy Policy is a separate notice explaining how personal information and other information are collected, used, disclosed, retained and protected when you use GasMap. It is not incorporated into these Terms as a contractual warranty. If you obtain GasMap through an app store, the applicable app-store terms and any applicable end-user licence agreement also apply.

GasMap helps users locate gas stations and compare recently reported fuel prices in Ontario, Canada.

Information displayed in GasMap may come from users, third-party sources and other data providers. Coverage, freshness and accuracy may vary by station and over time.

GasMap is not affiliated with, endorsed by or acting as an agent for any gas station unless expressly stated otherwise.

Fuel prices, fuel availability, station locations, ratings, distances, directions and estimated savings displayed through GasMap are provided for general informational purposes.

Prices and station information may be outdated, incomplete or inaccurate. A timestamp indicates when information was last reported or received; it does not guarantee that the information remains current.

Estimated savings are based on the information and assumptions displayed in GasMap and may differ from the amount you actually save. Estimated savings may not account for factors such as additional driving distance, fuel consumed while travelling, vehicle efficiency or changes in price after the information was reported.

Always verify the posted price and relevant station information before purchasing fuel or travelling to a station. You are responsible for deciding where and whether to purchase fuel.

Do not search for, review in detail, enter or submit information through GasMap while driving. Before interacting with GasMap, stop and park your vehicle safely and legally or have a passenger operate the app.

You are responsible for complying with applicable traffic, distracted-driving and road-safety laws. Do not rely on GasMap as your sole source of navigation, road-safety or emergency information.

GasMap may allow you to submit:

• Fuel prices;
• Price-accuracy votes;
• Star ratings;
• New stations;
• Station corrections;
• Reports about station closures or available fuel grades; and
• Other station information.

You are responsible for your submissions.

Fuel prices and other factual station information must be accurate to the best of your knowledge, submitted in good faith and based on information that you are authorized to provide.

Star ratings must genuinely reflect your own experience or assessment. They must not be submitted to manipulate a station’s rating, retaliate against a person or business, mislead other users or obtain an improper benefit.

Free-text station reports are submitted privately to GasMap for review and are not ordinarily displayed publicly. We may use the information in a report to investigate, verify, correct or update factual station information.

You must not submit information that:

• You know is false, misleading, fabricated or manipulated;
• Is submitted through bots, scripts or unauthorized automated means;
• Is intended to manipulate prices, ratings, votes or station information;
• Is unlawful, threatening, harassing, defamatory, discriminatory or abusive;
• Infringes another person’s intellectual-property, privacy or other rights;
• Contains another person’s private or personal information without lawful authority;
• Is advertising, spam or unauthorized commercial promotion; or
• Otherwise interferes with the integrity, security or operation of GasMap.

We may reject, correct, remove or limit the visibility of submissions. We may also apply rate limits, restrict submission functionality or use other reasonable technical measures to address abuse, fraud, security risks or violations of these Terms.

GasMap is not required to independently verify every submission.

Fuel prices may be displayed shortly after they are submitted. Displaying a reported price does not mean GasMap has independently verified that price or guarantees that the price remains available.

Star ratings reflect users’ reported experiences and opinions. They do not represent GasMap’s own assessment, endorsement or factual statement about a station.

Reports concerning station closures, fuel-grade availability or other station details may be reviewed before GasMap updates the information displayed in the app. We may request additional information, seek corroborating reports, label information as unverified or decline to act on a report.

If you believe that factual station information displayed in GasMap is inaccurate, contact us at [email protected] and identify:

• The station concerned;
• The information you believe is inaccurate;
• The correction you are requesting; and
• Any reasonable supporting information available to you.

If you believe that a rating or other submission is fraudulent, manipulated, unlawful, infringes your rights or violates these Terms, contact us at [email protected] and identify the submission and the basis for your report.

We may request reasonable supporting information before making a correction, restriction or removal decision.

We do not remove ratings merely because a station, business or other person disagrees with a user’s genuine opinion or reported experience.

You retain any rights you may have in your submissions.

By submitting information to GasMap, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, standardize, modify, analyze, combine and display the submission as reasonably necessary to operate, secure, maintain, improve and develop GasMap, including its aggregated data and analytics.

This licence includes the right to sublicense these activities to service providers acting on our behalf, but only to the extent reasonably necessary for them to provide services to GasMap.

This permission allows us to:

• Combine multiple reports;
• Calculate averages and estimated savings;
• Identify patterns and suspected abuse;
• Correct formatting and standardize data;
• Create aggregated or statistical information; and
• Use service providers to process submissions on our behalf.

We may transfer our rights and obligations under this licence as part of a merger, acquisition, financing, reorganization or sale of GasMap or substantially all of its relevant assets.

Any collection, use, disclosure or transfer of personal information remains governed by our Privacy Policy and applicable privacy law.

The licence may continue after a submission is removed to the extent that the submission has already been incorporated into aggregated data, statistical information, analytics, backups or records reasonably retained for legal, security, fraud-prevention or operational purposes.

GasMap may allow you to save stations, fuel types and other preferences.

These preferences may be stored locally on your device. They may be lost if you delete GasMap, clear its application data, replace your device or otherwise remove locally stored information.

We do not guarantee that locally saved preferences will be backed up, synchronized or recoverable.

You must not:

• Place an unreasonable or excessive load on GasMap’s systems, APIs or servers;
• Scrape, extract, collect or download GasMap data through automated means without our written permission;
• Attempt to circumvent rate limits, access controls or security measures;
• Interfere with GasMap or another person’s use of it;
• Reverse engineer, decompile, disassemble or attempt to discover GasMap’s source code, except to the extent permitted by applicable law, applicable app-store terms or the licence terms governing any open-source components included with GasMap;
• Copy, resell, redistribute or commercially exploit GasMap or its data without our written permission;
• Impersonate another person or falsely claim to represent a station, business or other organization;
• Attempt to gain unauthorized access to GasMap, another user’s device or any connected system; or
• Use GasMap for an unlawful or fraudulent purpose.

GasMap, including its software, design, branding, graphics, organization, features and original content, is owned by us or our licensors and is protected by applicable intellectual-property laws.

Subject to these Terms, any applicable end-user licence agreement and applicable app-store terms, we grant you a limited, non-exclusive, non-transferable and revocable licence to use GasMap for lawful, personal purposes. The licence may be accessed or used by other eligible users only where permitted by the applicable app-store terms or end-user licence agreement.

If these Terms conflict with an applicable Apple end-user licence agreement, that agreement will govern only with respect to the software licence and provisions required by Apple. These Terms will govern all other matters relating to the GasMap service.

Station names, logos and trademarks belong to their respective owners. Their appearance in GasMap does not imply sponsorship, partnership or endorsement.

GasMap is free to use and may display advertisements supplied through Google AdMob or other advertising providers.

Advertisements do not constitute GasMap’s endorsement of the advertiser or its products or services.

Our Privacy Policy separately explains how advertising identifiers, device information and related information may be handled.

GasMap may use or provide access to third-party maps, directions, websites, advertisements, data sources and other services.

Third-party services are governed by their own terms and privacy policies. We do not control and are not responsible for their availability, accuracy, content, security or practices.

Your use of a third-party service may require you to comply with that third party’s applicable terms.

We may add, modify, remove, suspend or discontinue any part of GasMap.

We do not guarantee that GasMap or any particular feature, data source or type of information will always be available.

We may release updates that are required for GasMap to operate properly or securely. Your ability to use GasMap may be affected if you do not install an available update.

We may update these Terms from time to time.

If we make a material change, we will provide notice through GasMap or by another reasonable method before the change takes effect.

Where a material change materially affects your rights or obligations, we will require you to affirmatively accept the updated Terms before they apply to your continued use of GasMap, unless applicable law permits the change to take effect through notice alone.

The updated Terms will apply from the effective date stated in them after any required notice, acceptance or consent has been provided or obtained.

Changes will not retroactively alter rights or obligations that arose before the updated Terms took effect unless permitted by law and expressly agreed.

You may stop using GasMap at any time by deleting the application.

We may reject submissions, restrict submission functionality or block access where we reasonably believe it is necessary to:

• Enforce these Terms;
• Address fraudulent, misleading or abusive activity;
• Protect GasMap, its users or third parties;
• Respond to security or technical risks;
• Prevent manipulation of prices, ratings, votes or station information; or
• Comply with applicable law.

Provisions that are intended by their nature to continue after your use of GasMap ends—including provisions concerning submissions, ownership, disclaimers, liability and dispute resolution—will continue to apply.

Except for warranties, conditions, rights and remedies that cannot lawfully be excluded, GasMap is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all express and implied warranties and conditions, including warranties and conditions of merchantability, fitness for a particular purpose, accuracy and non-infringement.

We do not guarantee that:

• Fuel prices or station information will be accurate, current or complete;
• A station will be open, accessible or carrying a particular fuel type or grade;
• User submissions or third-party information will be accurate;
• Estimated savings will be achieved;
• Maps, routes, distances or directions will be accurate or suitable for your circumstances;
• GasMap will be uninterrupted, completely secure or free from errors or harmful components; or
• Locally saved preferences will be retained or recoverable.

Nothing in these Terms excludes, restricts or modifies any warranty, condition, right or remedy that cannot lawfully be excluded, restricted or modified.

To the fullest extent permitted by law, Olivance Platforms Inc. and its directors, officers, employees, contractors and service providers are referred to collectively in this section as the “Protected Parties.”

The Protected Parties will not be liable for losses arising from or relating to:

• Inaccurate, outdated or incomplete fuel prices or station information;
• Differences between a displayed price and the price posted or charged at a station;
• Station closures, locations, accessibility or fuel availability;
• Maps, directions, distances or third-party services;
• Decisions you make based on information displayed through GasMap;
• User submissions, ratings, advertisements or third-party content;
• Service interruptions, technical errors, unauthorized third-party activity or loss of locally saved preferences; or
• Unsafe or unlawful use of GasMap.

To the fullest extent permitted by law, the Protected Parties will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost savings, lost data, loss of opportunity or the cost of obtaining substitute services.

These limitations apply regardless of the legal basis of a claim, including contract, negligence, tort or statute, except where liability cannot lawfully be limited.

To the fullest extent permitted by law, the total aggregate liability of the Protected Parties, collectively, arising from or relating to GasMap or these Terms will not exceed CAD $100.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct or any other liability that cannot lawfully be excluded or limited.

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to any mandatory rights you may have under applicable law, disputes relating to GasMap or these Terms will be subject to the jurisdiction of the courts of Ontario.

As between you and Olivance Platforms Inc., these Terms and any applicable end-user licence agreement constitute the agreement governing their respective subject matters concerning GasMap.

Our Privacy Policy describes our personal-information practices and is a separate notice. Nothing in these Terms limits any rights you may have under applicable privacy law.

The Protected Parties are intended third-party beneficiaries of Sections 15 and 16 and may enforce those sections directly.

If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be enforced to the greatest extent permitted by law and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

We may assign these Terms as part of a merger, acquisition, financing, corporate reorganization or sale of GasMap or substantially all of its relevant assets.

You may not assign or transfer your rights or obligations under these Terms without our written permission.

Headings are included for convenience only and do not affect the interpretation of these Terms.
